These Terms of Service (the “Terms”) govern your use of the Aluma platform (the “Platform”) by extracurricular education centers, families, students and teachers. By creating an account or using the Platform, you accept these Terms.
1. Description of the service
Aluma is a software-as-a-service (SaaS) platform that helps extracurricular education centers in Mexico manage enrollments, schedules, attendance, family communication and tuition billing. Each center contracts the Platform for its own use; families, students and teachers use it based on their relationship with a specific center.
2. Accounts and eligibility
- You must be of legal age to create an account. Minors are enrolled only by their guardians or by a center administrator.
- You are responsible for the accuracy of the information you provide and for keeping your password confidential.
- Notify us immediately at terminos@usaaluma.com if you detect unauthorized use of your account.
3. Subscription and billing to the center
Centers contract Aluma under a monthly or annual subscription plan, billed per active student during the billing period. The center authorizes Aluma to charge the contracted plan through the registered payment methods. Late payment may result in service suspension.
4. Family payments to the center (Stripe Connect)
When a family pays tuition through the Platform, the charge is made directly to the center's Stripe Connect account. The center acts as the merchant of record. Aluma facilitates the technical processing but is not a party to the educational services contract between the family and the center. Accordingly:
- The center issues the applicable tax receipts.
- Refund requests, adjustments and disputes are resolved directly with the center.
- Stripe fees are the center's responsibility under its contract with Stripe.
5. Acceptable use
You agree not to:
- Use the Platform for illegal, fraudulent or infringing purposes.
- Upload offensive, defamatory, discriminatory or age-inappropriate content.
- Attempt to access data of centers or users other than your own.
- Reverse engineer, decompile or attempt to extract the source code.
- Use bots, scrapers or automation beyond reasonable use.
6. Privacy and personal data
The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms. Each center is a co-controller of the data of the families linked to its organization.
7. Intellectual property
The Platform, its code, design, brand and content are the property of Aluma or its licensors. Nothing in these Terms grants you a license or right to use our trademarks beyond normal use of the Platform. Content uploaded by a center or family remains theirs; they only grant us the license necessary to host it and display it to authorized users.
8. Availability and support
We make reasonable efforts to keep the Platform available 24/7 but do not guarantee a specific level of availability unless contractually agreed. We perform scheduled maintenance that may cause brief interruptions. Support is provided by email and, depending on the plan, with priority response times.
9. Suspension and termination
We may suspend or terminate your account if you breach these Terms, if there is fraudulent activity, or upon request from a competent authority. The center may cancel its subscription at any time; service continues until the end of the billed period. Upon termination, we will retain data for the periods legally required and provide a reasonable export when requested.
10. Warranties and limitation of liability
The Platform is provided “as is”. To the maximum extent permitted by law, Aluma is not liable for indirect, incidental, special or consequential damages arising from the use of or inability to use the Platform. Our total liability for any claim is limited to the amount paid by the center during the last 12 months for the service related to the claim.
11. Changes
We may modify these Terms at any time. We will notify you of material changes by email or via a prominent notice in the Platform. Continued use after the effective date of the changes constitutes acceptance.
12. Governing law and jurisdiction
These Terms are governed by the laws of the United Mexican States. Any dispute will be resolved by the competent courts of Mexico City, with the parties waiving any other jurisdiction that may apply to them.
